This privacy policy governs Soil Direct's collection, use, and disclosure of non-public personal information ("NPPI") received from our current and former customers. We reserve the right to modify this privacy policy at any time, so please review it frequently. If we make material changes to this policy, we will notify you here, by email, or by a notice on our homepage.

We take the privacy and security of your information seriously and believe it is important that you understand:

Information We Collect

We collect the following categories of information: (i) information you provide such as your contact and delivery details; (ii) information about your transactions with us or our service providers; and (iii) information automatically collected as you interact with our website. We do not store your full credit card information — payments are processed securely by Square. For information about Square's privacy practices, see squareup.com/legal/privacy.

To process orders and provide our services, you may be asked to provide:

• Name
• Street or postal address
• Delivery address (if different)
• Email address
• Phone number

Traffic Data

We automatically track and collect traffic data. Traffic data is information that does not identify you personally but may include your IP address, internet service provider, browser type, referring pages, and similar information that helps us administer our site and improve our service offerings. If you arrive from one of our advertisements, the link carries campaign identifiers (such as "utm" parameters and an ad click id) that tell us which ad brought you here; we keep those identifiers with any inquiry or order you go on to make. We use cookies and similar technologies to track traffic data and customer transactions for accounting and analytics purposes. We may share anonymous, aggregate traffic and transactional information with our service providers for marketing, accounting, and site optimization purposes.

How We Use Your Information

We use the information we collect to identify you, complete your requests for products or services, fulfill orders, provide customer support, communicate with you about your account or transactions, and to send you newsletters and other customer-related material as permitted by law.

How We Share Your Information

Soil Direct may disclose the personal information we collect about you to:

• Service providers and affiliates who perform professional services for us, including payment processing (Square), delivery, demographic analysis, marketing, and accounting;
• Suppliers and delivery partners as needed to fulfill or respond to your request for products or services;
• Advertising measurement partners — currently Meta Platforms (Facebook and Instagram) — only when you reached our site from one of our ads, and only as described under Advertising & Ad Measurement below.

Soil Direct does not sell your personal information for money, and does not rent or otherwise disclose it to third parties except as explained in this privacy policy and as permitted by law. California law treats sending information to an advertising platform for ad measurement or targeting as "sharing" even when no money changes hands; see Your California Privacy Rights for how to opt out.

Data Sharing

• We do not share customer lists or contact details with third parties for their own promotional or marketing purposes. The only marketing-related disclosure we make is the ad-measurement sharing with Meta described in this policy, which is limited to visitors who arrived from our ads and which you can opt out of at any time.
• Mobile phone numbers, mobile opt-in, and consent are never shared with anyone for any purpose — including advertising partners. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.

Why We Need Your Email Address

We use your email address to:

• Confirm your identity;
• Send you information on the status of your transaction;
• Contact you if we need your assistance to complete a transaction;
• Send you newsletters and other customer-related material as permitted by law.

Soil Direct has a zero-tolerance policy for email abuse. If you receive unsolicited email from Soil Direct, please report it to us at privacy@SoilDirect.com. We will never ask you to provide personal information in an email. If you receive an email that appears to be from us requesting personal information, do not respond — contact us immediately at (888) 688-7645 or privacy@SoilDirect.com.

Your Choices

Email correspondence. You may opt out of marketing emails at any time by clicking the "unsubscribe" link in any email you receive, or by contacting us at privacy@SoilDirect.com. You may not opt out of transactional confirmation messages, which contain important information about your orders. If you do not wish to receive these messages, please do not place orders on this website.

Updating your information. If you want to change or delete your personal information, including your email address, please contact us at privacy@SoilDirect.com.

SOIL DIRECT Messaging Terms and Conditions

• The messaging program consists of general conversational messaging to answer questions and provide support to customers.
• You can cancel the SMS service at any time. Just text "STOP" to the phone number from which you received messages. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
• If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at info@soildirect.com.
• Carriers are not liable for delayed or undelivered messages.
• As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency will vary based on communication needs. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
• We maintain administrative, technical, and organizational safeguards, including access controls, staff training, and vendor restrictions, to prevent unauthorized sharing of user data.
• We do not transfer consumer data to any external organizations under any circumstances, even with user consent, except as strictly required to provide the requested service where permitted by applicable law.

Reserved Disclosure Rights

Soil Direct reserves the right to disclose your personal information without your consent: (i) to comply with federal, state, or local laws and other applicable legal requirements; (ii) to comply with a properly authorized civil, criminal, or regulatory investigation, subpoena, or summons; (iii) to respond to judicial process or governmental authorities; (iv) to our service providers to verify the integrity of information we collect; or (v) in connection with a sale, merger, or acquisition of Soil Direct or substantially all of its assets, in which case customer information will be one of the assets transferred.

Children's Privacy

We do not knowingly solicit information from children or send them requests for information. Soil Direct does not offer any services to persons under the age of 18.

Third-Party Sites

This privacy policy applies only to the Soil Direct website. It does not apply to any other website you may link to from our site or that may link to our site. We encourage you to review the privacy policies of every website you visit.

Security

Soil Direct uses industry-standard transport encryption (HTTPS/TLS) to protect information transmitted between your browser and our servers. Payment card data is tokenized and processed by Square; we do not store full card numbers on our systems. We maintain internal policies and access controls intended to protect your information from unauthorized access. No system is perfectly secure, however, and we urge you to take adequate precautions to protect your information online.

Analytics

We use Google Analytics and Microsoft Clarity to understand how visitors use the site — which pages are viewed, how the calculator and product pages are used, and where visitors run into trouble. These tools receive usage data and technical information about your device and browser; they do not receive the name, email address, or contact details you type into our forms. Google may also use its advertising cookies to measure orders that followed a Google ad. You can decline these tools in the prompt shown on your first visit, or at any time under Your California Privacy Rights.

Advertising & Ad Measurement (Meta Pixel and Conversions API)

We advertise on Facebook and Instagram. To learn whether those ads work, we use two tools provided by Meta Platforms, Inc.: the Meta Pixel (which runs in your browser) and the Meta Conversions API (which sends information from our servers). These tools are only activated for visitors who arrive at our site by clicking one of our ads — the link carries campaign identifiers that tell us so — and they stay active for that visitor for up to seven days. Visitors who arrive any other way are not tracked by Meta on our site.

When active, these tools share with Meta:

• The pages you view and the actions you take on our site: viewing a product, adding to cart, starting checkout, submitting payment, completing a purchase (including the order total), and submitting our contact or supplier-application forms;
• Technical information: your IP address, browser and device information, the campaign identifiers and ad click id from the link you followed, and Meta's own cookies (_fbp and _fbc) if present in your browser;
• When you submit a form or place an order, a hashed (SHA-256, one-way encoded) version of your email address and name, and the city, state, and ZIP code of your delivery address. Hashing means Meta can match the event to an account it already holds but cannot read the underlying values. We do not send your phone number, street address, payment details, or the contents of your messages.

Meta uses this information to measure and report on our ads, and may combine it with your Facebook or Instagram account and use it to deliver and personalize ads, as described in Meta's Privacy Policy. We keep the campaign identifiers on the record of your inquiry or order so we can see which campaign it came from.

How to opt out. Choose "Decline" in the prompt shown on your first visit, or use the control under Your California Privacy Rights at any time; either stops the Pixel and stops our servers from sending your information to Meta. We also honor the Global Privacy Control browser signal as an opt-out. You can separately control how Meta uses data from businesses in your Facebook ad settings, and opt out of interest-based advertising generally at optout.aboutads.info.

Your California Privacy Rights — Do Not Sell or Share

Soil Direct is based in California. We do not sell personal information for money. Under the California Consumer Privacy Act, as amended, sending information to an advertising platform such as Meta for ad measurement or targeting may be considered "sharing" for cross-context behavioral advertising. California residents have the right to opt out of that sharing, and we extend the same choice to every visitor. Use the control below, choose "Decline" in the prompt on your first visit, or enable the Global Privacy Control signal in your browser — we treat any of these as an opt-out and will not send your information to Meta. We will not discriminate against you for exercising this right.

You may also request access to, correction of, or deletion of the personal information we hold about you by contacting privacy@SoilDirect.com.

Cookies & Tracking

We use cookies and similar technologies to enhance your interaction with our website, remember your preferences, and analyze how the site is used. The cookies we set ourselves are:

• sd_session_id — an anonymous session identifier used to keep your cart and quotes together (two hours);
• sd_analytics_consent — your analytics and ad-measurement choice (one year);
• sd_ad_attribution — the campaign identifiers from the ad you clicked, set only when you arrive from an ad (seven days).

Third parties whose services run on our site also set cookies: Google (analytics and ads, e.g. _ga, _gcl_au), Microsoft Clarity, and — for visitors who arrived from a Meta ad — Meta (_fbp, _fbc). Declining in our prompt disables these. You may also reject cookies in your browser settings, but doing so may limit the functionality of our website.
